The arrest of the -perhaps under Sec.420 of Cr.PC is undoubtedly a good news. This offence should be brought under Drug & Magic Remedies Act 1954 too. While passing the order against the activities of Astrologers in 2000 or 2001 I observed that all diseases should be included in the Act and the Act to be amended accordingly to protect the people from the treachery of Astrlogers, Gurubabas, Gyangurus and such other antisocials and criminals and noted the observation in the ‘not for applicant’ note.Will respected Geetanath Ganguly please make any comment?

ओषधिनियंत्रण अधिनियम, १९५० – सन्‌ १९४९ में विदेशों से आनेवाली आवश्यक ओषधियों का बढ़ता हुआ मूल्य रोकने के लिये केंद्रीय सरकार की ओर से एक अध्यादेश जारी किया गया था, जिसको ओषधि अध्यादेश कहा जाता है। इसकी आवश्यकता आज भी बनी हुई है। कितने ही प्रदेशों ने अध्यादेश के स्थान पर ऐक्ट बना दिए हैं। सन्‌ १९५० में लोकसभा ने ड्रग्स कंट्रोल ऐक्ट पास किया। इस अधिनियम का अभिप्राय ओषधियों के विक्रय, प्रदाय और वितरण पर नियंत्रण करना है। इस अधिनियम में “ओषधि’ की वही व्याख्या मानी गई है जो सन्‌ १९४० के ऐक्ट की धारा ३ की अनुधारा बी में दी गई है। केंद्रीय सरकार किसी भी पदार्थ को इस अधिनियम के लिये “ओषधि’ घोषित कर सकती है। इस अधिनियम की अवहेलना या इसके आदेशों की पूर्ति न करना विधानानुसार दंडनीय है।

ड्रग्स ऐंड मैजिक रिमेडीज़ (ओव्जेक्शनेबिल एडवर्टिज़मेंट) ऐक्ट (ओषधि और जादू का उपचार (आपत्तिजनक विज्ञापन) अधिनियम), १९५४- इस ऐक्ट का अभिप्राय उन अश्लील और आपत्तिजनक विज्ञापनों को रोकना है जो बहुत समय से, विशेषतया स्त्रियों तथा पुरुषों के गुप्तांग संबंधी रोगों, बंध्यता तथा क्लीवता की चमत्कारी ओषधियों के संबंध में छपते रहे हैं। भोली भाली जनता इनके चक्कर में फँसकर धन और स्वास्थ्य दोनो गँवाती है। यह व्यवसाय इतना बढ़ गया था कि सरकार को यह ऐक्ट बनाना पड़ा, जिसके अनुसार ऐसा विज्ञापन करनेवाले को दंड मिल सकता है।
